Terms of Service
These Terms of Service govern your use of Peak Summit Sites' website design and development services. By engaging our services, you agree to these terms.
1. Services
Peak Summit Sites provides custom website design and development services for local businesses. The specific scope, deliverables, timeline, and pricing for each project will be outlined in a separate project agreement or invoice before work begins.
2. Payment Terms
Payment terms are as follows unless otherwise agreed in writing:
- A non-refundable deposit may be required before work begins
- Full payment or subscription billing begins upon project launch
- Monthly subscription plans are billed automatically on the same date each month
- Late payments may result in service suspension after a 7-day grace period
3. Project Timeline
We aim to deliver most websites within 1–2 days. Timelines depend on the client providing necessary content, feedback, and approvals in a timely manner. Delays caused by the client may extend the delivery timeline.
4. Revisions & Approval
Our process includes design mockup review and unlimited revision rounds on the initial mockup. Once the design is approved and development begins, significant scope changes may incur additional charges. We'll always discuss and agree on any additional costs before proceeding.
5. Client Responsibilities
The client agrees to:
- Provide all requested content (text, images, branding) in a timely manner
- Review deliverables and provide feedback within a reasonable timeframe
- Ensure they have the rights to any content or materials they provide
- Maintain the confidentiality of any login credentials we provide
6. Intellectual Property
Peak Summit Sites retains full ownership of the website, its design, code, and all underlying assets. The website is hosted on Landingsite's infrastructure, which Peak Summit Sites pays for. The client receives the right to use and operate the website for the duration of their active subscription — they run it, we own it. Peak Summit Sites retains ownership of any underlying code frameworks, reusable components, and development tools used to build the website. Peak Summit Sites may display the completed project in our portfolio unless otherwise agreed in writing. If the client's subscription is cancelled or terminated, the website is taken offline and the client does not retain any ownership, copy, or access to the website or its source code.
7. Hosting & Maintenance
Websites built by Peak Summit Sites are hosted on Landingsite's infrastructure. Hosting, SSL, and ongoing maintenance are included in monthly subscription plans. We do not provide source code downloads or support hosting on third-party servers. If a subscription is cancelled, the website will be taken offline.
8. Limitation of Liability
Peak Summit Sites is not liable for any indirect, incidental, or consequential damages arising from the use of our services or your website. Our total liability for any claim is limited to the amount paid by the client for the specific service giving rise to the claim.
9. Termination
Either party may terminate a project agreement with written notice. Upon termination, the client is responsible for payment for all work completed up to the date of termination. For monthly subscription plans, cancellation takes effect at the end of the current billing period.
10. Governing Law
These terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, followed by mediation if necessary.
